暫行辦法》，文件全文內(nèi)容如下：

第一章總則

第一條為了保證公用電信網(wǎng)的安全性、可靠性，提高公用電信網(wǎng)中主
要電信設(shè)備的抗震性能，根據(jù)國家有關(guān)規(guī)定，制定本辦法。

第二條本辦法適用于進入我國抗震設(shè)防烈度7烈度以上（含7烈度）地
區(qū)的公用電信網(wǎng)的交換、傳輸、移動基站、通信電源等主要電信設(shè)備的抗震性能檢測管理。

第三條凡在我國抗震設(shè)防烈度7烈度以上（含7烈度）地區(qū)的公用電信
網(wǎng)上使用的主要電信設(shè)備必須經(jīng)過抗震性能檢測，并獲得信息產(chǎn)業(yè)部頒發(fā)的電信設(shè)備抗震性能檢測
合格證（以下簡稱“檢測合格證”）。未獲得檢測合格證的電信設(shè)備，不得在抗震設(shè)防7烈度以上
（含7烈度）地區(qū)的公用電信網(wǎng)上使用。

第四條信息產(chǎn)業(yè)部綜合規(guī)劃司具體負責全國電信設(shè)備抗震性能檢測管
理工作。

各省、自治區(qū)、直轄市通信管理局依照本辦法的規(guī)定，負責本行政區(qū)
的電信設(shè)備抗震性能檢測管理和監(jiān)督檢查工作。

第二章檢測管理

第五條電信設(shè)備抗震性能的具體檢測工作，由信息產(chǎn)業(yè)部授權(quán)的通信
設(shè)備抗震性能質(zhì)量監(jiān)督檢驗機構(gòu)（以下簡稱檢驗機構(gòu)）負責。

第六條檢驗機構(gòu)應(yīng)當依據(jù)國家標準、通信行業(yè)標準及信息產(chǎn)業(yè)部的有
關(guān)規(guī)定對電信設(shè)備進行抗震性能檢測。

第七條檢驗機構(gòu)應(yīng)當在完成檢測工作后出具產(chǎn)品抗震性能檢測報
告。

第八條經(jīng)信息產(chǎn)業(yè)部授權(quán)的受理機構(gòu)具體負責受理檢測合格證的申
請。

第九條電信設(shè)備生產(chǎn)企業(yè)應(yīng)當向受理機構(gòu)提出書面申請。

書面申請應(yīng)當包括下列內(nèi)容：

（一）申請表一式兩份（格式附后），申請表應(yīng)當由生產(chǎn)企業(yè)法定代
表人或其授權(quán)人簽字并加蓋公章；境外電信設(shè)備生產(chǎn)企業(yè)應(yīng)當委托中國境內(nèi)的代理機構(gòu)提交申請
表，并出具委托書；

（二）實行進網(wǎng)許可制度的電信設(shè)備，應(yīng)當提交信息產(chǎn)業(yè)部頒發(fā)的進
網(wǎng)許可證，其他電信設(shè)備應(yīng)當提交國家產(chǎn)品質(zhì)量監(jiān)督部門認可的產(chǎn)品質(zhì)量認證報告或檢測報告；

（三）通信設(shè)備抗震性能質(zhì)量監(jiān)督檢驗機構(gòu)出具的電信設(shè)備抗震性能
檢測報告。

第十條自受理機構(gòu)收到完備的申請材料之日起30日內(nèi)，信息產(chǎn)業(yè)部綜
合規(guī)劃司對生產(chǎn)企業(yè)提交的申請材料審查完畢。經(jīng)審查合格的，頒發(fā)檢測合格證；經(jīng)審查不合格
的，將申請材料退回受理機構(gòu)，由受理機構(gòu)通知生產(chǎn)企業(yè)。

第十一條電信設(shè)備檢測合格后，發(fā)生同種設(shè)備結(jié)構(gòu)設(shè)計、焊接裝配工
藝、材料等變化可能影響抗震性能的，生產(chǎn)企業(yè)應(yīng)當在3日內(nèi)向信息產(chǎn)業(yè)部綜合規(guī)劃司報告。

信息產(chǎn)業(yè)部綜合規(guī)劃司對因前款原因可能造成抗震性能降低的電信設(shè)
備,應(yīng)當收回其檢測合格證。生產(chǎn)企業(yè)應(yīng)當按照本辦法規(guī)定的程序重新辦理檢測和申請核發(fā)合格證
書手續(xù)。

第三章監(jiān)督管理

第十二條信息產(chǎn)業(yè)部定期向社會公布獲得檢測合格證的電信設(shè)備和生
產(chǎn)企業(yè)。對獲得檢測合格證的電信設(shè)備進行抽查，并向社會公布抽查結(jié)果。

第十三條生產(chǎn)企業(yè)獲得檢測合格證后，應(yīng)當保證產(chǎn)品質(zhì)量和性能穩(wěn)
定。

第十四條生產(chǎn)企業(yè)有下列行為之一的，由信息產(chǎn)業(yè)部給予警告；情節(jié)
嚴重的，收回其檢測合格證或不再受理其檢測合格證的申請：

（一）申請檢測合格證時提供不真實申請材料的；

（二）獲得檢測合格證后降低電信設(shè)備抗震性能的。

第十五條電信設(shè)備抗震性能檢測報告、檢測合格證不得偽造、冒用、
涂改和轉(zhuǎn)讓。

違反前款規(guī)定，偽造、冒用、涂改、轉(zhuǎn)讓檢測合格證的，由省、自治
區(qū)、直轄市通信管理局給予警告，可以并處1萬元以下的罰款，情節(jié)嚴重的，可以并處1萬元以上3
萬元以下罰款。對轉(zhuǎn)讓的檢測合格證，由省、自治區(qū)、直轄市通信管理局收回。

第十六條電信業(yè)務(wù)經(jīng)營者不得在抗震設(shè)防7烈度以上（含7烈度）地區(qū)
的公用電信網(wǎng)中使用未獲得檢測合格證的電信設(shè)備。

違反前款規(guī)定的，由省、自治區(qū)、直轄市通信管理局責令其改正。

電信業(yè)務(wù)經(jīng)營者使用未獲得檢測合格證的電信設(shè)備，造成經(jīng)濟損失
的，由有關(guān)部門依法追究有關(guān)人員的責任。

第十七條檢驗機構(gòu)及其工作人員，有下列行為之一的，由信息產(chǎn)業(yè)部
責令改正；情節(jié)嚴重的，取消對檢驗機構(gòu)進行電信設(shè)備抗震性能檢測的授權(quán)；構(gòu)成犯罪的，依法追
究刑事責任：

（一）泄露被檢設(shè)備的技術(shù)秘密的；

（二）出具虛假證明或者出具錯誤數(shù)據(jù)造成嚴重后果的。

第十八條電信設(shè)備生產(chǎn)企業(yè)對檢驗機構(gòu)出具的檢測結(jié)論和檢測收費有
異議的，或者認為檢驗機構(gòu)的工作人員有違法違紀行為的，可以向信息產(chǎn)業(yè)部有關(guān)部門提出申訴。[!--empirenews.page--]

第十九條從事檢測合格證申請受理、審批的工作人員玩忽職守、濫用
職權(quán)、徇私舞弊的，依法給予行政處分；構(gòu)成犯罪的，依法追究刑事責任。

第四章附則

第二十條檢驗機構(gòu)的收費標準，參照國家規(guī)定制定，并按規(guī)定的程序
報有關(guān)主管部門批準后執(zhí)行。

第二十一條本辦法自2002年1月1日起施行。
